On November 2nd, 2022, ARCFE received the first four I-765 approvals for our investors who filed their I-526E petition concurrently with their Change of Status I-485 petition in late August. This is faster than the expected three months processing time USCIS announced back in March. Investors can expect to receive their EAD cards within 30 days of the approval notice email. Investors can legally begin working in the U.S. from the start date stated on their EAD cards.
The EB-5 Reform and Integrity Act of 2022 (“RIA”) offers great benefits to investors and their families, including concurrent filing. Concurrent filing allows investors who are already in the U.S. under a different visa category to file their I-526E petition at the same time with form I-485 to adjust their status without leaving the U.S. This also gives investors and their families immediate freedom to live, study and work in the U.S. while waiting for their Green Cards to be approved.
When investor chooses to do concurrent filing, they will need to file these four forms at the same time:
Form I-526E (“Immigrant Petition by Regional Center Investor”)
Form I-485 (“Application to Register Permanent Residence or Adjust Status”)
Form I-131 (“Application for Travel Document”)
Form I-765 (“Application for Employment Authorization”) – EAD Card
According to the New Cycle Time Goals USCIS announced back in March of this year, they aim to process the I-765 and I-131 petitions within 3 months, in which the I-765 will be adjudicated first. USCIS processes these two petitions separately to reduce I-765 processing times.
