【ARCFE News】 USCIS PUBLISHED FORM I-526E FOR REGIONAL CENTER’S INVESTORS

On July 12, 2022, USCIS published the new I-526 form, used specifically for the investors participating in the EB-5 Regional Center program called I-526E “Immigrant Petition by Regional Center Investor”. The new form requires additional extensive disclosures from both the investor and the Regional Center. EB-5 investors selecting Regional Center sponsored investment projects are now required to file this new I-526E form in place of the regular I-526 form.

Form I-526E requires the following information:

  1. Receipt number of filed form I-956F (project request)

  2. Bona fide information on EB-5 program participants

  3. Investor’s net worth

  4. Sources of EB-5 investment capital

  5. Breakdown of all fees

  6. Disclosures of investor’s prior work authorization and compliance with U.S. laws

In addition to the required information above, form I-526E also includes an “amendment” section, which may be used for investors who have previously invested in a troubled EB-5 project and need to amend their I-526 petitions.

The filing fee for Form I-526E is $3,675. If investors file a Regional Center-related Form I-526E on or after October 1, 2022, they must include a separate check for $1,000 as required by the EB-5 Reform and Integrity Act of 2022 (“RIA”). A separate biometrics service fee of $85 is also required for applicants submitting an initial I-526E petition. The Integrity Fund fee of $1,000 and $85 biometrics fee are not required for petitioners filing Form I-526E to amend a previously filed petition.
